Terms of Service

We appreciate you taking the time to read these Terms of Service (“Terms”). They’re important because they:

    •    Form a binding legal agreement between you (Hosts and Guests) and us

    •    Explain how our services are made available to you

    •    Apply to all interactions and communications you have through our platform

By using our platform, browsing, booking, or accessing any content or services — you’re agreeing to these Terms. If you don’t accept them, please don’t use the platform or book a service.

To make a listing or booking, you must accept these Terms. We may update them from time to time, and your continued use of the platform after changes go into effect means you accept the updated version.

1.    Application and Introduction

These Terms of Service (“Terms”) are a legally binding agreement between you and K9 Off-Leash Network (“we,” “us,” or “our”). They govern your access to and use of our website and any other services we offer — collectively called the K9 Off-Leash Network Platform.

Whether you’re browsing our site at www.offleashnetwork.ca, booking a private dog park, or hosting one, these Terms apply to you. You must be at least 18 years old to use the platform.

By creating an account — or even just using the platform without one — you’re agreeing to:

    •    These Terms

    •    Our Privacy Policy

    •    Our Host Standards

    •    Our Guest Standards

    •    Our Inclusion Policy

    •    Our Guest Release & Waiver of Liability

    •    Any other policies we share with you

2. K9 Off-Leash Network Service

i.    General Overview

K9 Off-Leash Network is an online platform that helps dog lovers (Guests) connect with Hosts who offer private spaces for off-leash time, training, or play.

    •    If you’re listing a space and offering services, you’re a Host.

    •    If you’re searching for, booking, or using a space, you’re a Guest.

    •    Some individuals may be both Host and Guest.

    •    Hosts can publish Listings for their Spaces, which Guests can book for personal use — whether it’s for training, giving reactive dogs a safe outlet, or just enjoying some joyful off-leash time. 

    •    All uses must be legal and respectful of the Host’s property.

ii.    What We Do — and Don’t Do

K9 Off-Leash Network provides the platform, but we don’t own, control, or manage any Listings or Host Services.

We’re not a Host, an insurer, or a pet care provider. We’re a neutral third party that helps facilitate connections between Hosts and Guests. The contract for the use of the property is formed directly between the Host and the Guest.

Our role is limited to:

    •    Making the website and services available

    •    Acting as a limited payment collection agent for Hosts — meaning we collect payments from Guests on behalf of Hosts, based on the amounts Hosts set.

iii.    Not Your Agent

We’re not acting as an agent for any User — Host or Guest — except when it comes to collecting payments for Hosts. That’s the only time we act on a Host’s behalf.

iv.    Service Disclaimer

We don’t guarantee or manage:

    •    The existence, safety, quality, legality, or suitability of any Listing or Host Service

    •    The accuracy of Listing descriptions, reviews, ratings, or other User content

    •    The behavior or performance of any User or third party

We also don’t endorse any User, Listing, Host, or Host Service. We encourage everyone to use good judgment, communicate clearly, and treat each other with respect.

v.    Cross-Border Data Transfers

Our servers may be located outside Canada. By using the Platform, you consent to the transfer and storage of your personal information outside Canada, subject to safeguards consistent with Canadian privacy law.

vi.    Privacy and Data Protection (PIPEDA)

K9 Off-Leash Network collects, uses, and discloses personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws. By using the Platform, you consent to such collection and use. We limit collection to what is necessary, safeguard your information, and provide access and correction rights as required by law. If personal data is transferred outside Canada, we will ensure appropriate protections are in place.

3. Host Terms

i.    General

As a Host, you can share your yard or space with our community of dog lovers — and earn money doing it! You’re in control: you create your Listing, set your price, availability, and rules. Hosting is flexible and designed to fit your lifestyle.

ii.    Legal Obligations

By becoming a Host, you confirm that your Listings and Host Services comply with all applicable laws, regulations, and agreements — including our Host Standards. You’re also responsible for handling personal data in accordance with privacy laws and our Privacy Policy. If you’re unsure how local laws apply, we recommend seeking legal advice.

iii.    Host Responsibilities

You’re responsible for your own actions and for anyone you involve in providing Host Services. That includes:

    •    Acting with integrity

    •    Treating Guests and others with respect

    •    Setting your fees and any additional terms for your Listing

    •    Ensuring that your space is safe, secure, and suitable for dogs and their humans.

iv.    Insurance

You are responsible for maintaining appropriate insurance coverage for your property and any activities conducted during bookings. While K9 Off-Leash Network does provide $1M in third-party liability insurance, K9 Off-Leash Network does not provide insurance or coverage for Hosts or their property.

v.    Respecting the Platform: Payments and Integrity

To keep things fair, transparent, and safe for everyone, all payments must go through the K9 Off-Leash Network Platform. This helps us protect Hosts and Guests, ensure accurate records, and maintain the integrity of our community. Collecting fees outside the Platform is strictly prohibited. It undermines the trust we work hard to build and violates our Terms of Service.

If a Host attempts to arrange payment or bookings outside the Platform, their account may be suspended or permanently removed. We take this seriously — not to be punitive, but to protect the values that make K9 Off-Leash Network special: honesty, accountability, and mutual respect. We’re here to support Hosts in building meaningful connections and earning income safely. Let’s keep it transparent, together.

vi.    Tax Obligations

As the Seller of Record, the Host is solely responsible for determining, collecting, and remitting all applicable federal, provincial, or local taxes (including but not limited to GST/HST/PST) related to their bookings. KOLN acts solely as a limited payment collection agent on behalf of the Host to facilitate the transfer of funds from Guests to Hosts.

You are responsible for determining, collecting, and remitting any applicable federal and provincial taxes (including GST/HST, PST, or QST) on the services you provide through the Platform. You must include applicable taxes in your listed prices. K9 Off-Leash Network does not remit taxes on your behalf and is not liable for your tax obligations. You are solely responsible for registering with the Canada Revenue Agency (CRA) or other relevant tax authorities if required.

vii.    CRA Reporting

In accordance with the Canada Revenue Agency’s Digital Platform Reporting Rules:

    •    K9 Off-Leash Network may be required to collect and report your earnings and personal information (including name, address, SIN or BN) to the CRA.

    •    You will receive an annual earnings summary by January 31 for the prior calendar year.

    •    You agree to provide accurate and complete information to facilitate this reporting.

viii.    Service Fees 

We charge a service fee for each booking made through the Platform. This fee is a percentage of the amount the Guest agrees to pay. It’s automatically deducted from the payment before it’s transferred to you.

Please note: Service fees are subject to change. We’ll always aim to provide advance notice if adjustments are made, and we’ll continue to prioritize fairness and transparency in how fees are applied.

ix.    Cancellation and Rescheduling

If you need to cancel or reschedule a confirmed booking, you must notify the Guest through the Platform as soon as possible. Repeated cancellations may impact your visibility or eligibility to Host.

x.    Discretionary Refunds

We reserve the right, at our sole discretion, to deny payment to a Host and issue a full refund to a Guest if necessary. This helps us maintain trust and fairness across the community.

xi.    Reviews

Guests may leave reviews about their experience. While we value transparency, we’re not obligated to share review content with you, even if your account is terminated. We may edit, remove, or screen reviews at any time, and we’re not liable for any changes or deletions.

xii.    Intellectual Property

You retain ownership of the content you upload, including photos and descriptions. By posting, you grant K9 Off-Leash Network a non-exclusive license to use this content for promotional and operational purposes.

xiii.    Assumption of Risk

Hosting through the K9 Off-Leash Network Platform involves inherent risks. By choosing to participate, you acknowledge and accept full responsibility for those risks, which include but are not limited to:

    •    Interactions with other Users, whether online or in person

    •    The presence of Guests and any individuals they invite onto your property

    •    Potential property damage, personal injury, theft, or other incidents that may occur during or because of a booking

You understand that allowing others onto your property — including unfamiliar individuals and dogs — carries unpredictable risks. You understand and agree that K9 Off-Leash Network is not responsible or liable for any damage, loss, or injury caused by Guests or their invitees, whether to persons, animals, or property.

You further acknowledge that:

    • You’ve had the opportunity to review and understand the Platform, its features, and any applicable laws or regulations.

    • You are not relying on K9 Off-Leash Network for legal advice, property protection, or insurance coverage.

    • You are solely responsible for evaluating and managing the risks associated with Hosting, including maintaining appropriate insurance and safety measures.

xiv.    Account Suspension or Termination

We may suspend or terminate your account if you violate these Terms, our Host Standards, or if we believe your continued participation may pose a risk to the community.

xv.    Dispute Resolution

If a dispute arises between you and a Guest, we encourage you to resolve it respectfully through the Platform. If needed, our support team may assist, but we reserve the right to make final decisions regarding refunds or account actions.

xvi.    Accessibility and Inclusion

We encourage Hosts to consider accessibility and be open to reasonable accommodations for Guests with disabilities, in alignment with our values of inclusion and respect.

4. Guest Terms

i.    Legal Obligations

As a Guest, you’re responsible for understanding and complying with all laws, rules, and agreements that apply to your use of a Host’s services.

If you book on behalf of a minor or bring a minor to a Host’s space, you must be legally authorized to do so and are solely responsible for supervising that minor at all times.

ii.    Guest Responsibilities

You’re accountable for your own actions — and for anyone you invite to join you at a Host’s space. That includes:

•    Acting with integrity

•    Treating Hosts, other Guests, and their property with respect

•    Evaluating whether a space is appropriate for your dog’s needs

Please use good judgment when booking, communicating, or interacting with other Users.

Photos shown in Listings are for reference only — they reflect the space at the time they were taken and are not endorsements by K9 Off-Leash Network.

iii.    Release & Waiver of Liability

Before booking any Host space, you must read and agree to the K9 Off-Leash Network Waiver & Release of Liability. This document outlines the risks associated with off-leash dog play and confirms your acceptance of personal responsibility. By completing a booking, you acknowledge that you’ve reviewed the Waiver and agree to its terms on behalf of yourself, your dog, and any guests you bring.

iv.    Damage to Property

You’re expected to leave the space as you found it. You’re responsible for any damage caused by you, your dog, or anyone you bring with you.

By agreeing to these Terms, you authorize us to charge your account for any fees or charges resulting from damage, without needing additional notice or consent.

v.    Host Cancellations

If a Host cancels your booking, you’ll receive a full refund — no questions asked.

vi.    Guest Cancellations

You may cancel a reservation up to 2 hours before the scheduled booking time and receive a full refund. Cancellations made within 2 hours of the booking time, or after the booking time has passed, are not eligible for refunds.

vii.    Assumption of Risk

Using off-leash spaces and participating in Host Services involves inherent risks — including the possibility of illness, injury, property damage, disability, or death.

By using the Platform, you accept full responsibility for those risks, whether they arise from interactions with other Users (including their dogs or guests), environmental conditions, or the nature of off-leash play.

It’s your responsibility to investigate whether a Host Service is suitable for you and your dog. You freely and willingly assume all risks associated with your participation, and you agree that K9 Off-Leash Network is not responsible or liable for any loss, injury, or damage that may occur during or as a result of your booking.

viii.    Respecting the Platform

All bookings and payments must be made through the K9 Off-Leash Network Platform. Attempting to arrange services or payments outside the Platform violates our Terms and may result in account suspension or removal. This helps us protect Hosts, Guests, and the integrity of our community. We’re here to support safe, transparent, and joyful experiences — and that starts with respecting the platform.

ix.    Dog Health and Behaviour

You are responsible for ensuring your dog is healthy, vaccinated, and well-socialized before visiting a Host’s space. Aggressive behaviour, excessive barking, or signs of illness may result in removal from the space and/or the Platform. Please be honest and proactive — it helps keep everyone safe and happy.

x.    Reviews

We love hearing about your off-leash adventures and encourage you to share your experience with the community. To keep things safe and constructive, K9 Off-Leash Network may moderate or remove reviews if they violate our guidelines. While we aim to preserve transparency, we’re not able to guarantee access to past reviews, even if your account is closed.

xi.    Account Suspension or Termination

We may suspend or terminate your account if you violate these Terms, engage in unsafe behavior, or act in a way that undermines trust within the community. We’re committed to maintaining a safe, respectful environment for all.

xii.    Dispute Resolution

If an issue arises during your booking, we encourage you to communicate respectfully with the Host. If you’re unable to resolve the matter, our support team may step in to help. We reserve the right to make final decisions regarding refunds or account actions.

xiii.    Intellectual Property

You retain ownership of any content you upload, including photos, captions, and descriptions. By posting, you grant K9 Off-Leash Network a non-exclusive license to use your content for promotional and operational purposes — always with respect for your voice and contribution.

xvii.    Consumer Protection Rights

Nothing in these Terms limits your rights under applicable provincial consumer protection legislation, including the Ontario Consumer Protection Act and the Quebec Consumer Protection Act. In the event of conflict between these Terms and mandatory consumer rights, the latter will prevail.

5. Content

i.    Profile Content

We may ask you — or allow you — to upload or submit text, photos, videos, reviews, and other materials to your profile on the K9 Off-Leash Network Platform (“Your Content”).

For example, Hosts are encouraged to create a profile with photos and share images of their space so Guests can get a clear idea of what to expect.

ii.    License to Use Your Content

By using the Platform, you grant K9 Off-Leash Network a worldwide, irrevocable, perpetual, non-exclusive, fully paid license to:

    •    Use, copy, display, reproduce, adapt, modify, transmit, broadcast, and distribute Your Content

    •    Create derivative works from Your Content

    •    Share Your Content with third parties for promotional or operational purposes

This license is subject to the limitations outlined in our Privacy Policy, especially regarding personal information.

iii.    Release of Rights

If Your Content includes your name, voice, image, likeness, or performance, you agree to release K9 Off-Leash Network and its Users from any claims — known or unknown — related to:

    •    Defamation

    •    Copyright infringement

    •    Invasion of privacy, publicity, or personality rights

This release applies to any use of Your Content and elsewhere in these Terms.

iv.    Your Representations & Warranties

By submitting Your Content, you confirm that:

    •    You own or have the legal right to use and share Your Content

    •    You’ve obtained any necessary permissions from people or pet owners featured in Your Content

    •    Your Content complies with all laws and these Terms

v.    Our Right to Manage Content

We reserve the right to monitor, edit, screen, or remove Your Content at our discretion.

We’re not obligated to:

    •    Retain Your Content

    •    Provide you with copies

    •    Notify you of changes or deletions

We’re also not liable for any loss, modification, or disclosure of Your Content. It’s your responsibility to keep backup copies of anything important.

6. Community Rules & Code of Conduct

As a member of the K9 Off-Leash Network community, as a Host and/or Guest, you agree to follow these rules and not assist or encourage others to break them. These guidelines help keep our platform safe, respectful, and enjoyable for everyone.

i.    Act with Integrity and Respect

We expect all Users to treat others — including Hosts, Guests, and third parties — with kindness and honesty. By accepting these Terms, you agree that:

    •    You will not lie, mislead, or misrepresent your identity or provide false information on your profile or during registration

    •    You will not impersonate another person or User

    •    You will not transfer or share your account access with anyone else

    •    You will not solicit usernames or passwords from other Users

    •    You will not post spam or unauthorized commercial content

    •    You will not interfere with the platform or disrupt other Users’ experience

    •    You will not harass, threaten, or target other Users or third parties

    •    You will not post content that is sexually explicit, violent, abusive, defamatory, or illegal — including content that violates privacy, intellectual property, or other legal rights

ii.    Use the Platform as Intended

You agree to use the K9 Off-Leash Network Platform only as permitted by these Terms and related policies.

•    You may only use another User’s personal information to complete a transaction through the Platform

•    You may not make or accept payments outside the Platform to avoid fees or taxes

•    You may only use your own content — or other Users’ content — to facilitate your role as a Guest or Host

•    You may not manipulate the search algorithm or engage in deceptive practices

iii.    Protect the Platform

You agree not to tamper with or misuse the K9 Off-Leash Network Platform in any way. Specifically, you will not:

    •    Use bots, scrapers, or automated tools to collect data or interact with the Platform

    •    Hack, disable, or bypass security features

    •    Reverse engineer, decompile, or disassemble any part of the Platform

    •    Take any action that could harm the performance or functionality of the Platform

iv.    Follow the Law

You agree to comply with all applicable laws and regulations, including:

    •    Privacy, data protection, and export laws

    •    All other policies provided by K9 Off-Leash Network, including our Privacy Policy, Host Standards, Guest Standards, and Inclusion Policy

    •    You will not use the Platform to compete with K9 Off-Leash Network

    •    You will not use our name, logo, branding, or trademarks without permission

    •    You will not register domain names, social handles, or other identifiers that could be confused with our brand

v.    Space Use Restrictions

To ensure safety and compliance, the following are strictly prohibited in any booked space:

    •    Unattended dogs

    •    Dogs declared dangerous by a court or animal control

    •    Dogs with a history of biting people or other animals

    •    Animals that are not dogs

    •    Pregnant dogs

    •    Dogs that do not meet our health requirements (see Vaccine Requirements)

    •    Humans without dogs

    •    Anyone under the influence of drugs or alcohol, including marijuana

    •    Minors booking on their own — minors are only allowed when accompanied by a parent or guardian who has booked and accepted the associated risks

vi.    Communications and CASL Compliance

    •    By using the Platform, you agree to receive transactional communications related to your bookings, account, and community participation. Marketing communications will only be sent with your express consent, and all messages will include a clear unsubscribe option, in compliance with Canada’s Anti-Spam Legislation (CASL).

7. Limitations on Liability

We operate the K9 Off-Leash Network Platform, while Hosts provide the actual listing services. To the fullest extent allowed by law, K9 Off-Leash Network is not responsible for:

    •    Any services offered or provided by Hosts

    •    Any actions, mistakes, or negligence by Hosts or related to their Listings

    •    Any injuries, property damage, death, or other losses resulting from Host services

i.    No Responsibility for Indirect Damages

K9 Off-Leash Network — including our team, affiliates, and partners — is not liable for any indirect or unexpected damages. This includes things like:

    •    Lost profits or income

    •    Business interruptions

    •    Lost contracts or data

    •    Damage to reputation or goodwill

These limits apply to any issues related to:

    •    Your use (or inability to use) the Platform

    •    Information you access through the Platform

    •    Removal of your profile, reviews, or content

    •    Suspension or termination of your account

    •    Technical errors, delays, or outages

ii.    Maximum Liability

Aside from our responsibility to transfer payments to Hosts, our total liability is strictly limited:

These limits are a core part of our agreement with you. 

8. No Guarantees (Disclaimer of Warranties)

We’re proud of the K9 Off-Leash Network Platform and the community it supports — but we need to be clear: we provide everything “as is,” without any promises or guarantees, whether express or implied.

That means:

    •    We don’t guarantee the behavior, safety, quality, legality, or suitability of any Guest, Host, Space, Listing, Host Service, or third party.

    •    We can’t promise the platform will always run perfectly or without interruptions.

    •    If we conduct any verification, identity, or background checks, we can’t guarantee they’ll catch past issues or prevent future ones.

If you see terms like “verified” on a User or Listing, it simply means they’ve completed a specific verification or identification step — nothing more.

9. Account Suspension and Termination

K9 Off-Leash Network reserves the right to suspend or terminate your access to the Platform — or any of its features — at our sole discretion, without prior notice or consent.

This may happen if:

         • You breach any part of these Terms

         • You violate applicable laws, regulations, or third-party rights

         • We believe it’s necessary to protect the safety or property of Users, K9 Off-              

               Leash Network, or others

         • Your account remains inactive for a period of time, as determined by us

         • We determine that your listing or participation is not feasible due to operational, 

               safety, legal, or quality concerns, including but not limited to location 

               limitations, service compatibility, or inability to meet platform standards.

We take these actions seriously and aim to protect the integrity of our community. If your access is terminated, you may lose access to your profile, content, bookings, and other data associated with your account.

10. Registration; Account Security

To access many features of the K9 Off-Leash Network Platform, you’ll need to create an account. This includes setting up a username, password, and user profile.

By registering, you agree to:

    •    Provide accurate, honest, and up-to-date information

    •    Create and maintain only one account tied to your real identity

    •    Be the sole authorized user of your account

    •    Keep your login credentials secure and confidential

    •    Notify us immediately of any unauthorized access or suspicious activity

You’re responsible for all activity that occurs under your account. That includes bookings, messages, and any interactions with other Users. We rely on you to help keep the community safe and trustworthy.

11. Force Majeure

K9 Off-Leash Network is not responsible for any delay or failure to perform that results from events beyond our reasonable control. These may include, but are not limited to:

    •    Natural disasters (e.g., earthquakes, floods, wildfires)

    •    Acts of God

    •    War, terrorism, riots, or civil unrest

    •    Government actions or military authority

    •    Pandemics, epidemics, or outbreaks of disease

    •    Strikes, labour shortages, or supply chain disruptions

    •    Shortages of transportation, fuel, energy, or materials

    •    Accidents or unexpected emergencies

In such cases, we may suspend or delay services without liability. These events are rare, but when they occur, we’ll do our best to communicate clearly and resume operations as soon as possible.

12. Copyright Infringement Claims

If you believe in good faith that your copyrighted work has been used on the K9 Off-Leash Network Platform without permission, you may submit a formal notice to us.

Your written notice must include the following:

    •    Description of the copyrighted work

            -    If multiple works are involved, please include a complete list.

    •    Description of the infringing material

            -    Include enough detail to help us locate it, such as the URL where the content appears.

    •    Your contact information

            -    Full name, mailing address, phone number, and email address.

    •    Good faith statement

            -    A declaration that you believe the use is not authorized by the copyright owner, their agent, or the law.

    •    Accuracy and authority statement

            -    A statement made under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

    •    Signature

            -    A physical or electronic signature of the person authorized to act on behalf of the copyright owner.

13. Indemnity

To the fullest extent permitted by law, you agree to release, defend (if we choose), indemnify, and hold harmless K9 Off-Leash Network — including our affiliates and team members — from any claims, damages, losses, liabilities, or expenses (including reasonable legal and accounting fees) that arise from:

    •    Your breach of these Terms

    •    Your violation of any K9 Off-Leash Network policy, rule, or guideline

    •    Your misuse of the Platform

    •    Your interactions with other Users or use of any Space, Listing, or Host Service — including injuries, property damage, theft, or death

    •    Your failure (or our failure at your direction) to properly report, collect, or remit taxes

    •    Your violation of any applicable laws or regulations

Cooperation & Control

You agree to cooperate with us in defending any claim covered by this section. We reserve the right to take exclusive control of the defense and resolution of any matter subject to indemnification, and you agree not to settle any claim without our written consent.

14. Intellectual Property

i.    K9 Off-Leash Network Platform

K9 Off-Leash Network and its licensors retain full ownership of the Platform and all related materials. This includes:

    •    The technology and software used to operate the Platform

    •    All electronic documentation and content (excluding Your Content) 

    •    All intellectual property and proprietary rights associated with the Platform, its software, documentation, and content

You may not copy, modify, distribute, or use any part of the Platform unless expressly permitted by these Terms.

ii.    Trademarks

K9 Off-Leash Network owns all rights to its trademarks, service marks, brand names, and logos (“K9 Off-Leash Network Marks”).

If you are a Host in good standing, we grant you a limited, revocable, non-exclusive, and non-transferable license to use the K9 Off-Leash Network Marks solely for:

    •    Use in approved goods, such as customizable marketing materials (e.g., business cards, signage)

    •    Any other use specifically authorized in writing via the Platform

By using our Marks, you agree that:

    •    All goodwill generated from your use of the Marks belongs exclusively to K9 Off-Leash Network

    •    Your license to use the Marks ends immediately if you are no longer a Host in good standing — whether voluntarily or due to suspension or termination by K9 Off-Leash Network

15. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. You agree that any disputes, claims, or legal proceedings arising out of or relating to these Terms or your use of the Platform will be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.

Language of the Terms

These Terms are provided in English. If you reside in Quebec, you may request a French version, and we will provide one in compliance with the Charter of the French Language.
